Agreement to Terms
By accessing or using OpenCourtyard ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
Description of Service
OpenCourtyard is a community management platform designed for apartment buildings and residential estates. The Service provides tools for issue tracking, voting, resident directories, newsletters, and community communication.
User Accounts
Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
Account Security
You are responsible for safeguarding your account password and for any activities or actions under your account. You must notify us immediately of any unauthorized use of your account.
Estate Membership
Access to estate-specific features requires approval from estate administrators. Your access may be revoked if you are no longer a resident or authorized user of the estate.
Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Harass, abuse, or harm other users
- Post false, misleading, or defamatory content
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use automated systems to access the Service without permission
- Collect or harvest user information without consent
- Use the Service to send spam or unsolicited communications
User Content
Ownership
You retain ownership of content you post to the Service. By posting content, you grant us a license to use, display, and distribute that content within the Service as necessary to provide our services.
Responsibility
You are solely responsible for the content you post. We do not endorse or guarantee the accuracy of any user content. We reserve the right to remove content that violates these Terms.
Estate Administrator Responsibilities
If you are an administrator of an estate on the Service, you agree to:
- Only invite legitimate residents or authorized users
- Manage user access responsibly
- Ensure your estate's use of the Service complies with applicable laws
- Respond to user concerns and maintain community standards
Fees and Payment
Some features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees. Fees are non-refundable except as required by law or as expressly stated in these Terms.
We may change our fees at any time. If we change fees for a subscription you have already purchased, we will provide notice before the change takes effect.
Intellectual Property
The Service and its original content (excluding user content), features, and functionality are owned by OpenCourtyard and are protected by international copyright, trademark, and other intellectual property laws.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Upon termination, your right to use the Service will immediately cease. You may request a copy of your data before termination.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.
Limitation of Liability
To the maximum extent permitted by law, OpenCourtyard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
